By accessing or using the website www.baumier.com (hereinafter referred to as the "Site") operated by Entreprise BeelivinU Inc. ("Baumier", "we", "us", "our"), you agree to be bound by these terms and conditions of use, which govern your use of the Site ("Terms and Conditions").

10. divisibility

In the event that one or more provisions of these Terms and Conditions are held to be unenforceable for any reason, the remaining provisions shall remain in full force and effect to the extent that they are not also held to be invalid.

11 Applicable laws and dispute resolution

These Terms and Conditions, your use of the Site and any matter arising therefrom shall be governed by the laws of Quebec. Any dispute arising out of or relating to these Terms and Conditions or your use of this Site shall be submitted to mediation in accordance with the rules set out in articles 605 et seq. of the Code of Civil Procedure. A representative of Baumier may, at his or her discretion, participate in the mediation.

If the dispute is not resolved within 45 days of service of a written request for mediation, it will be submitted to the exclusive jurisdiction of the competent courts of the judicial district of Montreal. Notwithstanding any provision to the contrary, we reserve the right to resort to the courts of our choice for the recovery of our fees, disbursements and costs.

12 Titles

The headings of certain sections and subsections contained in these Terms and Conditions are for convenience of reference only and shall not affect the meaning or interpretation of these Terms and Conditions.

13. full agreement

These Terms and Conditions supersede all prior terms and conditions to the same effect.

14. language

In the event of any conflict or inconsistency between the English and French versions of these Terms and Conditions, the French version shall prevail over any other version.

15 Modifications to terms and conditions

We reserve the right to modify these Terms and Conditions of Use at any time. Modifications will be effective immediately upon posting on the Site. By continuing to access or use the Site after changes are posted, you agree to be bound by the modified Terms and Conditions of Use.
