At Entreprise BeelivinU Inc ("Baumier", "we", "us", "our"), we take your privacy to heart.

The purpose of this privacy policy (the "Policy") is to help you understand how Baumier collects, uses, discloses and retains your Personal Information in the course of its business, and your rights and remedies with respect thereto.

The Baumier Website Terms and Conditions of Use are an integral part of this Policy, and govern the manner in which Baumier collects, uses and discloses your Personal Information in connection with your interaction with our website www.baumier.com (hereinafter referred to as the "Site").

1. What is personal information?

Within the meaning of Quebec's Act respecting the protection of personal information in the private sector, "Personal Information" is defined as information that allows a natural person to be identified, directly or indirectly.

This definition excludes information considered public. In fact, some information that directly identifies individuals is public and is not subject to the laws protecting Personal Information. This includes information concerning an individual's position within a company or public body, such as name, title, position, e-mail address, work address and telephone number.

Also, Personal Information is considered "Sensitive" when it gives rise to a high degree of reasonable expectation of privacy, particularly because of its nature or the context in which it is used. Examples of Sensitive Personal Information are those of a medical, biometric or otherwise intimate nature. It may concern health, sexual orientation, physical characteristics, ethnicity, beliefs or financial status.

2. What is the scope of this policy?

By providing us with Personal Information, you agree and authorize Baumier, its third parties and service providers to process such Personal Information in accordance with the manner set forth in this Policy.

You understand that this Policy does not apply to third-party websites that may be accessed through the Baumier Site by clicking on links, and that these sites have their own privacy policies. Accordingly, Baumier shall not be responsible or liable for any such third-party websites.

3. What information do we collect?

As part of your relationship with Baumier, you may be required to provide us with Personal Information, including through technological means. Baumier limits the collection of your Personal Information to that which is strictly necessary and appropriate for the purposes identified before or at the time of collection. As such, the Personal Information collected and processed by Baumier will depend on the nature of your interactions with Baumier.

Such Personal Information may include, but is not limited to:

- Personal Information for identification and contact purposes, as well as in connection with the improvement and management of your customer experience: Last name, first name, e-mail address, delivery address, language preference, purchase history.

- Personal financial and billing information: billing address, payment information

- Personal information related to staff recruitment: Curriculum Vitae

- Technical and numerical Personal Information related to the use of our Site and other platforms, including social networks: cookies.

Baumier does not collect Personal Information from persons under the age of 16. Any Personal Information concerning a minor under the age of 16 that has been communicated to us without the express consent of a person authorized by law will be destroyed.

4. How do we collect your personal information?

This collection of Personal Information may take place in person, or through e-mails received by our team members, online appointment request forms, by telephone or videoconference, or through cookies on our Site.

5. Why do we collect this information?

In the course of its activities, and as agreed with you at the time of collection, Baumier collects and uses Personal Information for the purposes identified and permitted or required by law, including:

- Order and payment processing

- Customer service and administration

- Improving our products and services

- Customer care

- Managing requests, complaints and claims

- Communication about our products, services, contests and promotions (with consent)

- Offer personalized recommendations based on needs and satisfaction questionnaires

- Job application processing and evaluation

Baumier strives to limit the collection of Personal Information to that which is necessary and appropriate for the performance of its activities.

From time to time, Baumier may also ask for your permission to use your Personal Information for secondary purposes, such as populating databases, distributing and subscribing to newsletters, training offers or other communications, and evaluating your level of satisfaction and needs in connection with our activities.

6. What about consent?

When you provide us with Personal Information, you consent to our collection, use, disclosure and processing of that Personal Information in accordance with this Policy and for the purposes described herein.

To the extent possible within the scope of its activities, and except in cases provided for or permitted by law, Baumier obtains your consent before collecting, using or communicating your Personal Information.

This consent may take the form of a specific prior action, such as ticking an acceptance box, or completing a form.

In the event that you provide Baumier with Personal Information concerning a third party, you acknowledge that you have obtained the consent or authorizations required for Baumier to collect, use or disclose such Personal Information in accordance with this Policy or that such collection, use or disclosure is authorized by applicable legislation.

7. How can you refuse the collection of information and what will be the consequences?

You may refuse to disclose certain Personal Information to Baumier, subject to applicable legal obligations.

You may, for example, refuse to accept non-essential cookies when consulting our Site, or refrain from disclosing Personal Information to us when we request it.

Consequently, you understand that Baumier may not be able to perform some or all of the services or actions you request if you refuse to provide the Personal Information requested, as these may depend on the Personal Information provided.  

8. Who can access your information?

Baumier will not disclose your Personal Information other than for the purposes for which it was collected, except in cases where we have obtained your prior consent, or in accordance with applicable legal requirements.

In order to fulfill the purposes for which your Personal Information was collected, certain categories of persons within Baumier or its group of companies, or in its service, may have access to your relevant Personal Information on a need-to-know basis.

Certain Baumier employees may have access to your Personal Information when required in accordance with this Policy.  

Baumier uses the services of certain third-party service providers to store or process Personal Information on our behalf, including for cloud computing, data hosting or application hosting services. Under no circumstances does Baumier sell or exchange your Personal Information for payment.

Baumier also uses the services of certain third-party service providers for online orders. Only the Personal Information necessary to fulfill the shipping, delivery and payment of online orders is transmitted to these third-party companies.

Depending on the nature of the services rendered by Baumier, it is possible that your Personal Information may be communicated outside Quebec.

9. What measures are taken to ensure the security of your information?

Baumier ensures the security of the Personal Information it holds throughout its life cycle, in accordance with the legislation applicable in the Province of Quebec, including the Civil Code of Quebec and the Act respecting the protection of personal information in the private sector of Quebec. As such, Baumier's reasonable security measures include physical, technological and administrative measures, in proportion to the nature and sensitivity of such Personal Information.

Baumier ensures the security of Personal Information accessible to its premises, notably by means of locks and secure access mechanisms. Individual workstations are password-protected. Baumier also uses servers designed with robust security measures to protect your files:

- Data encryption: Files are encrypted both during transfer (using HTTPS) and when stored on the servers.

- Threat protection: using advanced security systems to detect and block threats such as malware, spam and phishing attempts.

- Access control: We precisely control who can access our files and what their authorization levels are (read, comment, modify).

All of our storage and data transfers comply with Canadian law.

Every member of the Baumier team is trained in the protection of Personal Information. When we disclose Personal Information to third parties, such as service providers, we ensure by contractual means that we have sufficient guarantees that the level of protection of Personal Information will be at least equivalent to that offered by Baumier. These third parties are not authorized to disclose your Personal Information to others.

When Baumier transmits Personal Information outside Quebec, we first ensure that the Personal Information will benefit from adequate protection, particularly with regard to generally recognized principles of Personal Information protection. We therefore take into consideration the protection measures, including contractual ones, that the Personal Information would benefit from, in addition to considering the legal regime applicable in the country where the Personal Information would be communicated.

10. How long do we keep your personal information?

Baumier retains your Personal Information for as long as necessary to fulfill the purposes for which it was collected.

11. What are your rights?

Any individual concerned by Personal Information held by Baumier has the right to access such Personal Information, to have it rectified or updated, and to lodge a complaint.

You may also request that Personal Information about you no longer be disseminated by Baumier, or that any hyperlink attached to your name allowing access to this information by a technological means be de-indexed, under certain conditions provided for by law.

You may also withdraw or change your consent to the use or disclosure of your Personal Information, subject to Baumier's legal and contractual obligations. Except as required by law, Baumier will provide you with reasonable access to your Personal Information in order to exercise your rights.

If you wish to exercise one or more of these rights in relation to Personal Information concerning you, or for any request or complaint in connection with Baumier's policies and treatment of Personal Information, we invite you to contact the person responsible for the protection of Personal Information, at the following coordinates:

In the event of a privacy incident involving Personal Information about you that poses a risk of harm to you, we will contact you to the extent permitted by law.

In addition, we invite you to inform us immediately of any change in your Personal Information so that Baumier can make the necessary changes, if any (e.g. change of address or telephone number).

12. Policy update

In order to comply with the latest privacy legislation, Baumier may modify this Policy from time to time, at its sole discretion, without prior notice or liability to you or any other person. Consequently, we invite you to consult this Policy each time you visit our Site, in order to remain informed of the manner in which your Personal Information is handled.
